Agreement to Terms

By accessing or using Pistachio ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Use License

Permission is granted to temporarily use Pistachio for personal or commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose without explicit permission
• Attempt to reverse engineer any software contained in Pistachio
• Remove any copyright or other proprietary notations from the materials

User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

Payment Terms

Pistachio operates on a pay-as-you-go pricing model. You agree to pay all charges associated with your use of the Service. All fees are non-refundable unless otherwise required by law. Credits purchased do not expire unless otherwise stated.

User Content

You retain ownership of any content you create or upload to Pistachio. By using the Service, you grant us a license to use, store, and process your content solely for the purpose of providing the Service to you. You are solely responsible for the content you upload and represent that you have all necessary rights to such content.

Indemnification

You agree to indemnify, defend, and hold harmless Pistachio Technology Inc., its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

Prohibited Uses

You may not use the Service:

• In any way that violates any applicable law or regulation
• To transmit any malicious code or viruses
• To impersonate or attempt to impersonate another user or entity
• To engage in any automated use of the system that could harm the Service
• To interfere with or disrupt the Service or servers connected to the Service

Intellectual Property

The Service and its original content, features, and functionality are owned by Pistachio and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Disclaimer

The Service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, and hereby disclaim all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

In no event shall Pistachio, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Delaware, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Delaware, using the English language.

Export Control

You may not use or otherwise export or re-export the Service except as authorized by United States law and the laws of the jurisdiction in which the Service was obtained. In particular, but without limitation, the Service may not be exported or re-exported into any U.S. embargoed countries.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately. Any credits remaining in your account at the time of termination are non-refundable.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date.
